Digital Millennium Copyright Act (DMCA) Policy
At Everyday Spoon, we respect the intellectual property rights of others and expect the same from our users. In accordance with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), copyright owners or their authorized agents may submit valid takedown notices to our designated DMCA Agent.
As an online service provider, we operate under the DMCA’s “safe harbor” provisions, which limit our liability for copyright infringement claims as long as we comply with applicable law.
Filing a Notice of Infringement
If you believe that your copyrighted work has been used on our website without authorization, you must provide a written notice including all of the following:
- Signature – A physical or electronic signature of the copyright owner or an authorized representative.
- Description of Copyrighted Work – A clear description of the copyrighted material you claim has been infringed.
- Location of Infringing Material – The exact URL(s) where the allegedly infringing material appears.
- Contact Information – Your full name, mailing address, phone number, and email address (fax number if available).
- Good Faith Statement – A statement affirming your belief that the use of the material is unauthorized by the copyright owner, its agent, or the law.
- Accuracy Statement – A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf.
⚠️ Important: Under Title 17 USC §512(f), knowingly submitting false claims may result in penalties, including damages and attorney fees.

By submitting a claim, you acknowledge that we may share your notice (including your identity and contact details) with the alleged infringer.
Counter Notification – Request for Restoration
If your content was removed due to a DMCA notice and you believe it was taken down in error, you may submit a counter notification. Your written counter notice must include:
- Signature – Your physical or electronic signature.
- Description – Identification of the removed material and its original location.
- Good Faith Statement – A statement under penalty of perjury that the removal or disabling of the material was due to mistake or misidentification.
- Contact Information – Your name, address, and phone number.
- Jurisdiction Statement – Consent to the jurisdiction of the federal district court for your judicial district (or, if outside the U.S., any district where the service provider is located) and agreement to accept service of process from the party who filed the original DMCA complaint.

Repeat Infringer Policy
We take copyright violations seriously. In line with the DMCA, we keep records of infringement notices and make reasonable efforts to identify repeat infringers. Accounts of repeat offenders may be permanently terminated.
